1. General

1.1 Who are we?

These terms of service apply to the use of the CoachCraft application (hereinafter: "the App"), offered by:

CoachCraft is a web application that helps coaches create LinkedIn content using AI-generated content ideas and personalization tools.

1.3 Applicability

By using the App, you agree to these terms of service. Please read them carefully before using the App.

2. Definitions

• App: The CoachCraft web application at coachcraft.io
• User / You: The person using the App
• We / Us: Maak Jouw Impact B.V. / CoachCraft
• Content: All texts, images, and other materials in or generated by the App
• AI Content: Texts and suggestions generated by artificial intelligence
• LinkedIn Integration: The connection between the App and your LinkedIn account

3. Account and access

3.1 Creating an account

To use the App, you need an account. Your account is personal and may not be shared with third parties.

3.2 Your responsibility

You are responsible for:

• Keeping your login credentials confidential
• All activities that take place under your account
• Providing correct and up-to-date information

3.3 Access

We may suspend or terminate your access to the App if:

• You violate these terms
• You use the App for unlawful purposes
• You fail to meet payment obligations (if applicable)

4. Use of the App

4.1 Permitted use

You may use the App for:

• Generating and personalizing LinkedIn content
• Saving and managing your content
• Publishing content to LinkedIn (via the integration)
• Viewing statistics of your LinkedIn posts

4.2 Prohibited use

You may not use the App to:

• Distribute spam, misleading, or illegal content
• Infringe on the rights of third parties
• Reverse-engineer or hack the App
• Use the App for automated bulk activities
• Generate content that violates the LinkedIn terms of service

5. AI-generated content

5.1 Nature of AI content

The App uses artificial intelligence to generate content suggestions. This AI content:

• Is a tool and suggestion, not a finished product
• May contain inaccuracies or errors
• Should always be reviewed by you before publication
• Is generated based on your input (tone of voice, ideal client, etc.)

5.2 Your responsibility

5.3 No guarantees

We make no guarantees about:

• The accuracy or completeness of AI-generated content
• The suitability of content for your specific situation
• The reach or success of published content on LinkedIn
• The performance or results of using the App

6. LinkedIn integration

6.1 Connection

You can connect your LinkedIn account to the App to:

• See your real profile photo in previews
• Post directly to LinkedIn
• View statistics of your posts

6.2 Consent

By connecting your LinkedIn account:

• You give us permission to post to LinkedIn on your behalf
• You give us permission to retrieve your profile information and post statistics
• You accept both our terms and the LinkedIn API Terms of Use

6.3 Disconnecting

You can disconnect the connection at any time via the settings in the App.

6.4 LinkedIn terms

The use of the LinkedIn integration is subject to the LinkedIn User Agreement and LinkedIn Privacy Policy.

7. Intellectual property

7.1 Our rights

The App, including the underlying software, templates, design, and content (excluding content provided or generated by you), is the property of Maak Jouw Impact B.V. or its licensors.

7.2 Your content

The content you provide (profiles, stories, images) and the content generated for you and personalized by you, remains your property.

7.3 License to us

You grant us a limited license to use your content for providing the service (storing, processing, displaying).

7.4 Feedback

If you provide feedback or suggestions about the App, we may freely use these to improve the App.

8. Privacy

We process personal data in accordance with our Privacy Policy. By using the App, you agree to this processing.

9. Availability and maintenance

9.1 Availability

We strive for high availability of the App, but cannot guarantee 100% uptime.

9.2 Maintenance

We may temporarily take the App offline for maintenance or updates. For planned maintenance, we will try to inform you in advance.

9.3 Changes

We may modify, expand, or remove features of the App. We will inform you of significant changes.

10. Liability

10.1 Limitation

To the extent permitted by law, our liability is limited to:

• Direct damages: A maximum of the amount you paid to us in the 12 months prior to the event causing the damage, with a maximum of EUR 500.
• Indirect damages: We are not liable for indirect damages, consequential damages, lost profits, missed savings, or damages due to business interruption.

10.2 Exclusions

We are not liable for:

• Damages caused by content you publish on LinkedIn
• Damages caused by inaccuracies in AI-generated content
• Damages caused by outages or unavailability of LinkedIn or other third parties
• Damages caused by unauthorized use of your account

10.3 Force majeure

We are not liable for failures due to force majeure, including outages at hosting providers, LinkedIn, or other third parties.

11. Payment

11.1 Current situation

Currently, access to the App is provided through the CoachCraft program.

11.2 Future changes

We reserve the right to introduce paid features or subscriptions in the future. You will be informed in a timely manner.

12. Duration and termination

12.1 Duration

This agreement takes effect when you start using the App and continues until it is terminated.

12.2 Termination by you

You may stop using the App at any time and have your account deleted.

12.3 Termination by us

We may terminate the agreement:

• With a notice period of 30 days
• Immediately in case of violation of these terms

12.4 Consequences of termination

Upon termination:

• Your access to the App will be revoked
• You may request an export of your content within 30 days
• Your data will be deleted in accordance with our privacy policy

13. Changes to terms

We may modify these terms. For significant changes:

• We will inform you at least 14 days in advance
• You have the right to terminate the agreement if you do not agree

By continuing to use the App after changes, you agree to the new terms.

14. Miscellaneous

14.1 Transfer

We may transfer our rights and obligations to a third party, for example in case of sale of the business.

14.2 Severability

If any provision of these terms is void or voidable, the remaining provisions shall remain in full force and effect.

14.3 No waiver

If we do not (immediately) exercise a right under these terms, this does not mean we waive that right.

15. Applicable law and disputes

15.1 Applicable law

These terms are governed by the laws of the Netherlands.

15.2 Disputes

Disputes shall be submitted to the competent court in 2254 AE Voorschoten, the Netherlands, unless mandatory law provides otherwise.

15.3 EU Online Dispute Resolution

If you are a consumer in the EU, you may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
